NomNak Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the NomNak mobile application and related services (collectively, the “Service”) operated by Matthew Hefferon (“NomNak,” “we,” “us,” or “our”).

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use NomNak. By using the app, you represent that you meet this requirement and that the information you provide is accurate.

If you are under the age required where you live, you may not use the Service. You may not use the Service if you are barred under applicable law or if we have suspended or terminated your account.

2. Your account

• You are responsible for activity on your account and for keeping your credentials secure.
• Provide accurate information (e.g. email, username) and keep it up to date.
• You may sign in with email and password, Sign in with Apple, or Google, as offered in the App.
• You may delete your account at any time via Profile → Settings → Delete account. Deletion is permanent and removes your NomNak profile and associated content from our systems, subject to our Privacy Policy and legal retention obligations.

3. The Service

NomNak is a social food discovery app. You can post photos and ratings (Love, Ok, or Skip) for restaurants, follow friends, save places, view maps and discovery feeds, and interact with other users’ content.

We may change, suspend, or discontinue features at any time. The Service is provided “as is” without warranties except where prohibited by law.

4. User-generated content

NomNak lets you post photos, ratings, and other content about restaurants (“User Content”). You keep ownership of your User Content, but you grant NomNak a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute it solely to operate and improve the service.

You represent that you own or have the rights to post User Content and that it does not violate these Terms or any law.

4.1 Prohibited content

You agree not to post or share User Content that:

• Is illegal, fraudulent, or misleading
• Is harassing, threatening, hateful, discriminatory, or promotes violence
• Is sexually explicit or exploits minors
• Infringes someone else’s intellectual property, privacy, or publicity rights
• Contains spam, malware, or deceptive promotions
• Impersonates another person or misrepresents your affiliation

You also agree not to spam, scrape, use automated means without permission, upload malware, attempt to disrupt the Service, collect other users’ data without consent, use the Service for commercial solicitation without our written permission, or circumvent security or access controls.

5. Community standards and enforcement

NomNak has no tolerance for objectionable content or abusive users. We may remove content, restrict features, or terminate accounts that violate these Terms, with or without notice, at our sole discretion.

6. Reporting and blocking

If you see content or behavior that violates these Terms, you can:

• Report a spot or user from the in-app menu (⋯) on a post or profile
• Block a user from the same menus; blocked users’ content is hidden from your feed and search

Reports are stored in our systems and reviewed by our team. You may also email matt@nomnak.com with details.

Blocking another user does not notify them. You can unblock users in Settings → Blocked users.

7. Moderation

We review reports of objectionable content and abusive behavior and aim to take appropriate action within 24 hours, including removing content, suspending accounts, or banning repeat offenders. We may also act on content we become aware of through other means.

We are not obligated to monitor all User Content but reserve the right to do so.

8. Your responsibility

You are responsible for your User Content and your use of NomNak. Use the reporting and blocking tools in good faith. False or abusive reports may result in action against your account.

9. Other users’ content

User Content is the responsibility of the person who posted it. NomNak does not endorse User Content. Your interactions with other users are at your own risk.

10. Location, maps, and third-party data

Restaurant names, addresses, photos, and map data may come from third parties (e.g. Google Places, Mapbox). That data may be inaccurate or incomplete. NomNak does not guarantee venue information, hours, safety, or suitability.

Location features require your permission. You can deny location and still use parts of the Service (e.g. text search).

11. Intellectual property

NomNak’s name, logo, App design, and software are owned by us or our licensors. Except for the limited rights in Section 4, you may not copy, modify, or distribute our intellectual property without permission.

If you believe content on the Service infringes your copyright, contact matt@nomnak.com with:

• Identification of the work;
• Identification of the infringing material and where it appears;
• Your contact information;
• A statement of good-faith belief and accuracy under penalty of perjury;
• Your signature (physical or electronic).

12. Privacy

Our Privacy Policy explains how we collect and use personal information. It is incorporated into these Terms.

13. Acceptable use of Apple and Google

If you download the App from the Apple App Store or Google Play:

• These Terms are between you and NomNak, not Apple or Google.
• Apple/Google are not responsible for the Service or its content.
• Apple/Google have no obligation to provide maintenance or support for the App.
• To the extent permitted by applicable store rules, Apple/Google are third-party beneficiaries of these Terms and may enforce them against you.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free.

Food and health: Ratings and posts reflect user opinions, not professional advice. Always use your own judgment regarding allergies, dietary needs, and food safety.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOMNAK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR $0 IF THE SERVICE IS FREE).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

16. Indemnity

You will defend and indemnify NomNak against claims arising from your User Content, your use of the Service, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

17. Termination

We may suspend or terminate your access at any time for violation of these Terms or for any other reason with or without notice.

You may stop using the Service at any time and delete your account as described in Section 2.

Sections that by nature should survive (licenses granted for operational logs, disclaimers, liability limits, indemnity, dispute terms) survive termination.

18. Disputes and governing law

These Terms are governed by the laws of Utah, USA, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country apply.

Informal resolution: Contact matt@nomnak.com first; we will try to resolve disputes in good faith.

Courts: If we cannot resolve a dispute informally, you and NomNak agree that any claim arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Washington County, Utah, except that either party may bring an eligible claim in small-claims court.

19. Changes

We may modify these Terms. We will post the updated Terms at https://nomnak.com/terms and update the “Last updated” date. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Service and delete your account.
